Canada-based AI vendors are governed federally by the Personal Information Protection and Electronic Documents Act (PIPEDA) and, in some provinces, by substantially similar provincial laws (Quebec's Law 25, British Columbia's PIPA, Alberta's PIPA). The federal government has proposed the Artificial Intelligence and Data Act (AIDA) which would establish an AI-specific regulatory regime; as of writing it is not yet in force. Canada has an EU adequacy decision (commercial activities only, narrower than the UK's).
Buyer considerations
- Canada-EU adequacy decision is narrower than UK adequacy and may not cover all data flows.
- Quebec's Law 25 imposes stricter consent and transparency requirements than PIPEDA.
- AIDA is not yet in force; current AI rules are principles-based PIPEDA guidance.
